1. Acceptance of Terms

By accessing or using the Dotter and Pop website ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Who Can Use the Service

You must be at least 16 years old to use the Service. By using the Service, you confirm that you meet this age requirement. We do not verify age during sign-up but the signup page discloses the age requirement.

3. Accounts and Registration

An account is required to use our Service. For information collected during registration and how to delete your account, please see our Privacy Policy.

You are responsible for all activity under your account. Keep your login credentials secure. If you believe your account is compromised, notify us immediately.

4. User Content and Conduct

You may submit prompts and upload files to use with the provided language model tools. These prompts and responses are stored securely. Some files may be downloaded locally (e.g., configuration files or PDF reports). You are responsible for any files you download and store.

You may share your account activity with others through our invitation system. This grants invitees access to your prompt history from the date they join. Deleting history is available in some cases, but deleted data cannot be recovered.

You must not:

  • Submit illegal, abusive, or infringing content
  • Attempt to hack or disrupt the system
  • Use the system in ways that cause excessive cost or resource use
  • Violate intellectual property or privacy rights of others

We may suspend or terminate accounts at any time for any reason, including abusive or excessive use. If the company ceases operations, accounts and data may be deleted without notice.

Some user content may be accessed by developers for debugging or maintenance purposes. This access is limited and non-routine.

5. Intellectual Property

All software, design, and platform content is owned by Dotter and Pop, Inc. Users are granted a limited license to access and use the Service.

We make use of third-party and open-source software, which is subject to their own licensing terms.

To report intellectual property concerns or infringement, email info@dotterandpop.com with detailed information about the incident. We do not respond to automated or vague requests.

6. Payments and Subscriptions

The Service may offer paid subscriptions or credits.We do not offer refunds.Payments are handled through Stripe.

There are two ways to cancel, via the Billing Portal (stripe) or via our Overview tab on the Account page. When you cancel via Stripe, you retain access until the end of your renewal period. When you cancel via the Overview tab, as noted on the tab, the cancellation is immediate.

Free trials may be offered at our discretion and are subject to limitations. Limitations may include limits on usage of provided large language models, or the limitations may be time based. For example, we may choose to limit the number of prompts in a time period. A free trial is an example that may have both kinds of limitations. Accounts and/or subscriptions may be suspended or canceled if payment is not receive on a timely basis.

7. No Warranties

This Service is in beta. This means the system has not been released, and may have undocumented limitations. We provide no guarantees about system availability, uptime, features, accuracy, or reliability. The feature set of this system is intentionally evolving rapidly and we do not guarantee that particular features will be available.

You use the Service at your own risk. No warranties, express or implied, are provided.

We may offer fee-based professional services, but any automated responses or system outputs do not constitute legal, financial, or medical advice.

8. Limitation of Liability

To the maximum extent allowed by law:

  • Dotter and Pop is not liable for indirect, incidental, or consequential damages
  • Liability is capped at the amount you paid us, if any
  • We are not responsible for third-party services, outages, or misuse

9. Suspension and Termination

We may suspend or delete your account at any time for any reason, including but not limited to:

  • Violation of these Terms
  • Inactivity
  • Operational necessity

We may delete user data 30 days after account termination.

10. Governing Law and Disputes

These Terms are governed by the laws of California, United States. Any legal claims must be brought in San Francisco County, California.

We encourage users to reach out to us first to resolve disputes informally.

11. Changes to These Terms

We may update these Terms at any time. Changes will be posted on our website.

By continuing to use the Service after changes are posted, you agree to the updated Terms.

12. Third-Party Services

We use third-party services such as Supabase, OpenAI, and Stripe. Use of these services is subject to their terms, which are linked or referenced within our platform.

We disclaim responsibility for outages or issues arising from third-party platforms.

13. Privacy

We maintain a separate Privacy Policy, which explains how we collect, use, and share personal data in compliance with California law (CCPA/CPRA).

14. Accessibility and International Use

This site is designed for U.S. users. We do not guarantee accessibility compliance under WCAG or compliance with non-U.S. laws (e.g., GDPR).

15. Beta Disclaimer

The Service is in beta. Features may be unstable or change at any time.

No warranties or guarantees are provided for any feature during this period.
